A male daycare worker was arrested evening of July 27 at a barangay in San Isidro, Leyte.
The accused (name withheld) is a 33-year-old daycare worker, married, and a resident of Brgy. Baruguhay Sur, Carigara, Leyte. He is considered as the Top 9 Most Wanted Person in Carigara.
The arrest was by virtue of a Warrant of Arrest dated July 20, 2022 for the crime of frustrated violation of Section 5, paragraph (b) of RA7610 issued by Judge Emelinda R. Maquilan, Presiding Judge, RTC Branch 13, 8th Judicial Region, Carigara, Leyte with a recommended bail of P200,000.00 for the temporary liberty of the accused.
Section 5 (B) of RA 7610 states that “Those who commit the act of sexual intercourse or lascivious conduct with a child exploited in prostitution or subject to other sexual abuse; Provided, That when the victims are under twelve (12) years of age, the perpetrators shall be prosecuted under Article 335, paragraph 3, for rape and Article 336 of Act No. 3815, as amended, the Revised Penal Code, for rape or lascivious conduct, as the case may be: Provided, That the penalty for lascivious conduct when the victim is under twelve (12) years of age shall be reclusion temporal in its medium period;”
The accused was arrested through the joint operatives from San Isidro MPS led by Police Major Reymund U. Quinagutan, ACOP and the Carigara MPS led by Police Lt. Renato P. Gerona, DCOP.
